1. Acceptance of Terms

By accessing or using Melodusk ("Service") at melodusk.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Melodusk is an AI-powered music generation platform that allows users to create music using artificial intelligence. Our Service includes text-to-music generation, lyrics-to-song conversion, and related features.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Subscription and Payments

4.1 Pricing Plans

We offer various subscription plans with different features and credit allocations. Current pricing is available on our pricing page. Prices are subject to change with notice.

4.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. Payment is processed through Stripe. You authorize us to charge your payment method for all fees incurred.

4.3 Credits

Credits reset monthly on your billing date. Unused credits do not roll over to the next billing period.

4.4 Refunds

We offer a 7-day money-back guarantee for monthly plans and a 14-day guarantee for yearly plans. Refund requests must be submitted to support@melodusk.ai within the applicable period.

Refund amounts are calculated based on the percentage of remaining credits in your account at the time of the refund request. The formula is:

Refund Amount = Original Payment × (Remaining Credits ÷ Total Credits)

Example: If you purchased a plan for $10 with 100 credits and have used 30 credits (70 remaining), your refund would be:

$10 × (70 ÷ 100) = $7.00 refund

Platform Fees: Third-party payment processing fees incurred during the original payment and refund process (e.g., Stripe transaction fees) are non-refundable and will be deducted from your refund amount. These fees are charged by the payment processor and are beyond our control.

5. Intellectual Property Rights

5.1 Your Content

You retain ownership of the prompts and inputs you provide. For generated music, ownership and usage rights depend on your subscription plan.

5.2 Commercial License

Paid subscription plans include commercial usage rights for generated content. Free plan users may only use generated content for personal, non-commercial purposes.

5.3 Our Content

The Melodusk platform, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Generate content that infringes on others' intellectual property rights
  • Create harmful, abusive, or offensive content
  • Attempt to reverse engineer or extract our AI models
  • Use automated tools, bots, or unofficial APIs to access the Service
  • Circumvent any usage limits or security measures
  • Share your account credentials with others
  • Resell or redistribute generated content as a competing service

7. Unlimited Plan

With the Unlimited plan, you can generate music an unlimited number of times. Using credits enables priority high-speed generation without queuing. However, we maintain an anti-abuse system to prevent extreme cases of misuse or malicious behavior.

The Unlimited plan is for personal use within the Melodusk platform only. Using unofficial APIs, automation tools, or any method to bypass our system is strictly prohibited. Accounts found violating these terms may be suspended or terminated without refund.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time through your account settings.

Upon termination, your right to use the Service will immediately cease. Your generated content may be deleted after a reasonable period following account termination.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MELODUSK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

11. Indemnification

You agree to indemnify and hold harmless Melodusk and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
