Terms of Service

Last updated: February 2, 2026

1. Acceptance of Terms

By accessing or using Melodusk ("Service") at melodusk.ai, you agree to be bound by these Terms of Service. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms. If you do not understand or agree to these Terms, please do not use our Service.

Important: Section 20 contains an arbitration agreement and class-action waiver that may affect your legal rights, including your right to a jury trial or to participate in a class action. You may opt out as described in Section 20.

2. Description of Service

Melodusk is an AI-powered music generation platform that allows users to create music using artificial intelligence. Our Service includes text-to-music generation, lyrics-to-song conversion, and related features.

In these Terms, “User Input” means any prompt, lyric, audio, image, text, or other material you submit; “User Output” means content generated by the Service in response to User Input; and “Your Content” means User Input, User Output, and other material you post, upload, submit, or make available through the Service. You are responsible for Your Content and for ensuring that it complies with law, third-party rights, and these Terms.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

You may update available account details through your profile settings. We may rely on the information you provide for account, billing, security, and legal communications. If you know or suspect that your account or credentials have been compromised, notify us promptly at support@melodusk.ai. You may not create a new account to evade a suspension or termination.

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, your parent or legal guardian must review and accept these Terms on your behalf. Children under 13 may not use the Service.

4. Subscription and Payments

4.1 Pricing Plans

We offer various subscription plans with different features and credit allocations. Current pricing is available on our pricing page. Prices are subject to change with notice.

4.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. Payment is processed through Stripe. You authorize us or our payment processor to charge your payment method for all fees and applicable taxes incurred. You represent that your billing information is accurate, current, complete, and that you have legal authority to use the payment method. Failed or reversed payments may result in suspension or termination of paid features.

4.3 Plan Changes and Upgrades

If you upgrade or change a paid plan during a billing period, we may charge or credit the prorated difference shown at checkout, together with applicable taxes. Changes take effect as described on the pricing or checkout page.

4.4 Credits

Credits reset monthly on your billing date. Unused credits do not roll over to the next billing period.

4.5 Refunds

We offer a 7-day money-back guarantee for monthly plans and a 14-day guarantee for yearly plans. Refund requests are subject to the terms below.

If you experience issues using the Service after payment, or if you are dissatisfied with the product, you must first contact our support team at support@melodusk.ai within the applicable refund period and describe the issue in reasonable detail so we can review it and attempt to resolve it.

If you contact our support team within the applicable refund period, your eligibility to request a refund will be preserved while we review or attempt to resolve the issue. If our support team is unable to resolve your issue, or if you remain dissatisfied after receiving support assistance, you may then apply for a refund.

Refund amounts are calculated based on the percentage of remaining paid credits in your account at the time of the refund request. Free credits obtained through promotions, sign-up bonuses, holiday events, or other non-payment sources are excluded from refund calculations. The formula is:

Refund Amount = Original Payment × (Remaining Paid Credits ÷ Total Paid Credits)

Example 1 (Monthly Plan): If you purchased a monthly plan for $10 with 100 credits and have used 30 credits (70 remaining), your refund would be:

$10 × (70 ÷ 100) = $7.00 refund

Example 2 (Annual Plan): If you purchased an annual plan for $100 with 1,200 total credits (100 credits × 12 months) and have used 200 credits (1,000 remaining), your refund would be:

$100 × (1,000 ÷ 1,200) = $83.33 refund

Note: If you have both paid credits and free promotional credits in your account, the system prioritizes using paid credits first when calculating refunds. Only the usage of paid credits affects your refund amount.

Platform Fees: Third-party payment processing fees incurred during the original payment and refund process (e.g., Stripe transaction fees) are non-refundable and will be deducted from your refund amount. These fees are charged by the payment processor and are beyond our control.

4.6 Renewals and Cancellation

Unless your checkout page states otherwise, subscriptions renew automatically for the same subscription period at the then-current price. You may cancel future renewals through your account or billing settings; cancellation takes effect at the end of the then-current paid period unless applicable law requires an earlier refund or termination. We may notify you of material price or plan changes before they take effect.

5. Intellectual Property Rights

5.1 Your Content

You retain ownership of the prompts and inputs you provide. For generated music, ownership and usage rights depend on your subscription plan.

5.2 Commercial License

Paid subscription plans include commercial usage rights for generated content. Free plan users may only use generated content for personal, non-commercial purposes.

Any commercial-use permission provided by Melodusk applies only to the rights Melodusk can grant in the Service and does not include or replace rights belonging to third parties. You are solely responsible for obtaining all permissions, licenses, and releases required for any lyrics, recordings, samples, melodies, names, likenesses, trademarks, or other materials that you submit or use with generated content.

5.3 AI-Generated Content Disclaimer

Melodusk provides an automated creative tool and does not select, endorse, or guarantee the originality, legality, registrability, or non-infringing nature of any input or generated output. AI-generated music, lyrics, artwork, titles, and other outputs may resemble existing works or contain elements that are subject to third-party rights, including copyright, trademark, privacy, publicity, or personality rights. You must independently review each output and obtain any permissions required before publishing, distributing, monetizing, or otherwise using it commercially. You assume all risks arising from your use of inputs and outputs.

5.4 Our Content

The Melodusk platform, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws.

“Melodusk,” our logos, product names, designs, graphics, slogans, and related marks are our trademarks or those of our licensors. Other marks displayed through the Service belong to their respective owners. No license to use any mark is granted without our prior written permission.

5.5 License to Operate the Service

You grant Melodusk a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, and technically modify your inputs and generated content solely as necessary to provide, secure, and improve the Service, comply with law, and investigate or respond to rights-holder reports. We do not claim ownership of Your Content. This license ends when the applicable content is deleted from our systems, except for limited copies retained in backups or records as described in our Privacy Policy.

6. License to Use the Service

Subject to these Terms, Melodusk grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and display materials we provide solely for your permitted use of the Service. The Service, including its interface, software, models, algorithms, documentation, and branding, is not Your Content. We may interrupt access for maintenance, updates, security, capacity, or other operational reasons.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Submit, upload, or request the generation of any lyrics, recordings, samples, melodies, artwork, text, or other material that you do not have the legal right to use, or that infringes or misappropriates any third-party copyright, trademark, trade secret, privacy, publicity, or other rights
  • Request or attempt to reproduce, imitate, or substantially copy a specific copyrighted song, lyrics, recording, or other protected work, including by providing its title, lyrics, audio, or other identifying material without authorization
  • Use the name, voice, likeness, identity, or signature style of a living artist or other person in a way that implies endorsement or violates that person's rights
  • Generate, publish, or distribute content that infringes on others' intellectual property rights
  • Create harmful, abusive, or offensive content
  • Attempt to reverse engineer or extract our AI models
  • Use automated tools, bots, or unofficial APIs to access the Service
  • Circumvent any usage limits or security measures
  • Frame, replicate, or build an interface to access the Service except through interfaces we expressly provide
  • Use robots, spiders, crawlers, scrapers, or other automated or manual processes to monitor, mine, extract, copy, or collect data from the Service
  • Introduce viruses, malware, ransomware, trojan horses, worms, logic bombs, or other malicious code
  • Disable, overburden, damage, disrupt, or impair the Service or interfere with another person’s access
  • Attempt unauthorized access to the Service, another account, or connected systems or networks
  • Remove, alter, deactivate, degrade, or circumvent technological measures or content protections
  • Use Melodusk trademarks, logos, or proprietary notices without our written permission
  • Use User Input or User Output to develop a competing product, service, or technology
  • Use or distribute User Output in a misleading way, including falsely claiming it is entirely human-generated or endorsed by a person or brand
  • Share your account credentials with others
  • Resell or redistribute generated content as a competing service

7.1 Content Review and Enforcement

To protect users, rights holders, and our payment partners, Melodusk may use automated filters and, where appropriate, human review to evaluate prompts, uploads, and generated outputs for suspected infringement, abuse, or other violations of these Terms. We may block or modify a request, refuse to generate content, remove or restrict access to content, and suspend or terminate accounts that we reasonably believe violate these Terms. We may also act on reports from rights holders or payment networks and retain limited records of review and enforcement actions as permitted by law.

We do not undertake to monitor or review all content and are not required to identify every potentially infringing item. Our decision to review, restrict, or leave content available does not waive any rights or remedies.

Automated checks may produce false positives or fail to detect unlawful content. A review or successful generation does not constitute approval, verification, or a warranty that content is lawful or non-infringing. You remain responsible for reviewing and clearing all inputs and outputs before use.

If you believe content on the Service infringes your copyright, you may send a notice consistent with 17 U.S.C. § 512(c) to support@melodusk.ai identifying the copyrighted work, the allegedly infringing content and its location, your contact information, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that the information is accurate and that you are authorized to act, and your physical or electronic signature. We may remove or restrict access to identified content and notify the submitting user. A user may submit a legally valid counter-notice; we may restore content at our discretion after evaluating the notice and any counter-notice. We may terminate accounts of repeat infringers.

8. Legacy Unlimited Plan

Legacy Unlimited subscriptions remain subject to the original Unlimited plan terms. The Unlimited plan allowed unlimited generations subject to our anti-abuse system. Using unofficial APIs, automation tools, or any method to bypass our system is strictly prohibited. Accounts found violating these terms may be suspended or terminated without refund.

New subscriptions are offered under the Lite, Pro, and Studio plans. Studio plan users receive a defined monthly credit allowance and do not receive unlimited slow generations.

8a. Credits

Subscription credits reset monthly on your billing date. Unused monthly credits do not roll over to the next period.

Yearly subscriptions include the same monthly credit allowance as the corresponding monthly plan, billed once per year at a lower effective monthly price. Yearly subscriptions do not include additional bonus credits.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time through your account settings.

We may suspend, disable, or delete an account or any part of the Service with or without notice where we reasonably believe it is necessary to protect users, rights holders, payment partners, or the Service. If your account is terminated for a violation, you may not re-register under another name without our written permission. Any licenses granted under these Terms terminate automatically upon termination, except for provisions intended to survive.

Upon termination, your right to use the Service will immediately cease. Your generated content may be deleted after a reasonable period following account termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

To the maximum extent permitted by law, Melodusk disclaims responsibility for the accuracy, availability, security, reliability, originality, legality, or non-infringing nature of the Service and any content created, uploaded, posted, sent, received, or stored through it. We do not guarantee that any generated output is suitable for a particular purpose, eligible for copyright protection, or clear of third-party rights. You use the Service and all outputs at your own risk.

We are not responsible for loss, deletion, corruption, or failure to store or transmit Your Content. You should maintain your own backups of prompts, uploads, and generated files that are important to you.

Some jurisdictions do not allow limitations on implied warranties or certain damages. To the extent those laws apply, the exclusions and limitations above apply only to the maximum extent permitted, and you may have additional rights.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MELODUSK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, INCLUDING LOSSES ARISING FROM YOUR CONTENT OR YOUR USE, PUBLICATION, OR COMMERCIALIZATION OF GENERATED OUTPUTS.

Our total liability for all claims relating to the Service will not exceed the greater of US$100 or the amount you paid us for the Service during the six months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited.

12. Indemnification

You agree to indemnify and hold harmless Melodusk and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, penalties, or expenses (including reasonable attorneys' fees) arising from or relating to your inputs, generated outputs, publication or commercialization of content, alleged infringement or misappropriation of any third-party rights, violation of these Terms, or violation of any applicable law or payment-network rule.

13. Injunctive Relief

You acknowledge that unauthorized use of the Service, our technology, or our intellectual property may cause irreparable harm for which monetary damages are inadequate. We may seek injunctive or other equitable relief, in addition to any remedies available at law, without needing to prove actual damages or post a bond where permitted by law.

14. Changes to Terms

We may modify these Terms by posting an updated version and changing the “Last updated” date. For material changes, we will use reasonable efforts to notify you by email or a prominent notice. Changes become effective when posted or on a later date stated in the notice. Your continued use after the effective date constitutes acceptance. Changes do not apply to a dispute already formally commenced before the effective date.

15. Third-Party Services and Materials

The Service may rely on or link to third-party services, including payment processors, cloud storage, hosting providers, and AI model providers. Third-party services and materials are provided under their own terms and privacy policies. Melodusk does not warrant or endorse their availability, accuracy, quality, legality, copyright compliance, or security and is not responsible for losses caused by them.

16. Beta Features

We may offer experimental or beta features. Their use is voluntary and at your own risk. Beta features are provided “as is,” may contain errors, may be changed or discontinued without notice, and may result in loss or corruption of data. Confidential beta features may not be disclosed without our written permission.

17. Export Controls and Sanctions

You must comply with applicable export-control and sanctions laws. You may not access or use the Service from a jurisdiction subject to applicable U.S. embargoes or provide access to a person or entity on a government restricted-party list. You represent that you are not located in, or acting on behalf of, such a restricted jurisdiction or party.

18. Feedback

If you voluntarily provide suggestions, comments, or other feedback, you grant Melodusk a perpetual, worldwide, royalty-free right to use and disclose that feedback to operate and improve the Service without payment or attribution. Do not submit confidential information or third-party material as feedback.

19. General Provisions

These Terms are the entire agreement between you and Melodusk regarding the Service and replace prior understandings about the same subject. If any provision is held unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or transfer of the Service. Provisions that by their nature should survive termination, including intellectual-property, disclaimers, limitations, indemnification, and dispute provisions, will survive.

A failure to enforce any provision is not a waiver of future enforcement. Section headings are for convenience only and do not affect interpretation. Our Privacy Policy, available at melodusk.ai/privacy, explains how we handle information used with the Service.

20. Dispute Resolution; Arbitration

Before starting a formal proceeding, you and Melodusk agree to contact the other party and make a good-faith effort to resolve the dispute informally. Send your notice to the contact address below and allow 30 days for a response. This informal process is a condition precedent to arbitration where permitted by law.

Except for the claims listed below, any dispute arising out of or relating to the Service or these Terms will be resolved by final, individual, and binding arbitration administered by a recognized U.S. arbitration provider under its applicable consumer rules. The arbitration will be conducted in English by one arbitrator, and judgment on the award may be entered in any court with jurisdiction. You and Melodusk waive trial by jury and agree not to bring or participate in a class, collective, consolidated, or representative action to the fullest extent permitted by law.

Either party may bring an individual claim in small-claims court if it qualifies, seek individual injunctive relief, or bring an intellectual-property claim in a court with jurisdiction. You may opt out of arbitration by emailing support@melodusk.ai within 30 days after first accepting these Terms, identifying your name, account email, and clear election to opt out. If you opt out, Melodusk will not be bound by arbitration for disputes with you. Nothing here limits rights that cannot lawfully be waived.

21. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

If you are a California resident, you may submit consumer complaints to the California Department of Consumer Affairs, Consumer Information Division, as provided by California Civil Code Section 1789.3. Nothing in these Terms limits any non-waivable consumer rights.
